This Privacy Policy describes how we handle information collected online via websites operated by us, software applications made available by us, social media pages that we control, mobile applications we control, email messages that we send to you, and the information we collect and use to provide you with the best experience we can offer in connection with our gaming and hotel systems, vacation booking services, and loyalty programs such as the Boyd Rewards Loyalty Program (collectively, the “Services”).

WHAT PERSONAL INFORMATION WE COLLECT
“Personal Information” is information about you as an identifiable individual, for example, your:
- Name, contact information, and social media information. Name, personal device ID, and contact information including postal address (billing and shipping addresses); email address; telephone number; social media account ID; IP address; and Boyd Rewards account number and other loyalty program information.
- Government Issued IDs. Identifiers, such as name and government-issued identifier (e.g., Social Security number, driver's license number, or license plate number).
- Pictures and recordings of you. Profile pictures, and audio, electronic, visual, and similar information.
- Financial information. Information including credit and debit card numbers, and commercial information such as transaction information, banking and financial account information, and purchase history.
- Sensitive Personal Information. Characteristics of protected classifications under California or federal law, such as age, gender, medical conditions, and marital status.
- Biometric data. Information such as fingerprints, facial recognition, and other information that permits us to identify an individual.
- Geolocation information. Your physical location based on information from your mobile device. You can control whether this information is shared by choosing from the options on your device, such as “Always”, “Only while using,” or “Never”.
- Public social network activities. Information you make available to everyone, or to us, via any social network service.
- Inferences about you. Inferences drawn from any of the Personal Information listed above to create data analytics and other new information in the form of a profile or summary about, for example, your preferences and characteristics.
HOW WE COLLECT PERSONAL INFORMATION
We collect Personal Information in a variety of ways, including:
- When you interact with us, such as when you sign up to receive newsletters, offers, and promotions, create or log into your account, make a reservation or a purchase, or share information with us through any other means including through the Services and your social media account.
- When you visit our casino properties, whether just to visit, transact business, or when you contact customer service.
- When you use your mobile device or computer, based on your permission settings, or when you use our mobile apps, such as Boyd Rewards mobile app, Boyd Sports mobile app, or online services.
- From other sources such as: public databases, joint marketing partners, social media platforms, and other third parties. For example, if you choose to sign into your Boyd Rewards account via your social media account, Personal Information about you and your friends associated with your social media account may become available to us.
HOW WE USE PERSONAL INFORMATION
We use Personal Information for legitimate business purposes:
- Answer your questions. To respond to your inquiries and fulfill your requests, for example, sending you newsletters.
- Sharing administrative information. To send administrative information to you, for example: sending information regarding the Services and changes to our terms, conditions, and policies, or information regarding your gaming activity.
- Purchases. To complete and fulfill your purchase, for example: processing your payments, confirming your reservation, communicating with you regarding a reservation or purchase, and providing you with related customer service.
- Mobile features. To help you engage with our mobile apps and our online services, for example: using the Boyd Rewards mobile app, or the VIP Player Club, to find the casinos nearest you, using our other mobile apps to participate in online gaming, connecting to gaming machines through your personal mobile device (for example, through a Bluetooth pairing), and receiving notifications from the casino you are visiting.
- Marketing. To enhance our marketing efforts and to send you marketing communications that we believe may be of interest to you.
- Personalized experiences. To personalize your experience by presenting products and offers tailored to you, as well as personalizing, advertising, and marketing our products and services.
- Contests. To allow you to participate in sweepstakes, contests, and similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use or disclose your Personal Information. We suggest you read these additional rules carefully.
- Communications. To allow you to send messages to another individual through the Services.
- Geolocation information. We may use your geolocation information to send you offers, tailored advertisements and promotions, and make available other location-specific services. We may also use geofencing technology that interacts with your device's location capabilities to determine whether you've entered a specific location. Information from geofencing technology helps us confirm that you are located in a particular jurisdiction where you are permitted to use certain Services. We may also use geofencing technology to determine when you enter a specific location where we and our third-party partners may send you offers, advertisements, or provide services tailored to that location. If you chose not to share your location information with us, you may lose access to certain Services.
- Other business purposes. To support the products and services which make your experience with us as rewarding as possible and to otherwise support our business. These purposes included, for example, developing, improving, and maintaining our properties, products, and services and otherwise operating and expanding our business. In addition: conducting audits and internal investigations, research, analytics, and data analysis, accounting, maintaining our facilities and infrastructure, undertaking quality and safety assurance measures, determining the effectiveness of our promotional campaigns, performing identity verification, and maintaining records.
- Legal compliance & fraud detection. As we believe to be appropriate or necessary: (1) to comply with laws or with legal process served on us as well as with our internal policies; (2) to respond to requests from public and government authorities; (3) to enforce our terms and conditions; and (4) for fraud monitoring, detection, and prevention; and (5) otherwise to protect and defend the rights, privacy, property, safety, or operations of us, you, or our affiliates (including through surveillance).
HOW PERSONAL INFORMATION MAY BE SHARED
Your Personal Information may be shared with:
- Affiliates. With our affiliates for the purposes described in this Privacy Policy.
- Service providers. With our third-party service providers who provide services, such as: website hosting, application development and hosting, data analysis, payment processing, order fulfillment, show and event ticketing, reservation management, credit and other bank account authorization, technology-driven services, customer service, email delivery, auditing, and other services.

- Promotion sponsors. With third parties that sponsor, operate, or otherwise collaborate with us for sweepstakes, contests, and similar promotions.

With your friends associated with your social media account, with other website users and with your social media account providers, in connection with your social sharing activity, such as if you connect your social media account to a Service account or log into your account on the Service through your social media account. By connecting your Boyd account and your social media account, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media site's privacy policy.
- Third parties in connection with any reorganization, merger, sale, etc. With third parties in connection with any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
- Public, government, or public safety authorities or other legal-matter entities. As we believe to be necessary or appropriate: (1) to comply with laws, regulations, or with legal process; (2) to respond to requests from public and government authorities; (3) to enforce our terms and conditions; and (4) to protect and defend the rights, privacy, safety, property, or operations of us, you, our affiliates, or others.

HOW WE MAY COLLECT OTHER INFORMATION
We and our third-party service providers may collect Other Information in a variety of ways, including:
- Through a browser or device. Certain information is collected by most browsers or automatically through a device such as an Internet Protocol (IP) address, browser type, and operating system. We use this information to ensure that the Services function properly. We may also collect information about your use of our Services including, without limitation, internet or other electronic network activity information about your access of the Services or playing games via our business products and/or your interaction with our Services via other third party websites or applications, such as internet protocol addresses, geolocation information, browser type, referring / exit pages and URLs, other browser history, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, payments, and related date and time information. - Through your use of our apps. When you use our apps, including Boyd Rewards, Boyd Sports, or the VIP Player Club, we and our service providers may track and collect app usage data such as the location, date, and time the app on your device accessed our servers and what information and files were downloaded to the app based on your device identifier.
- Cookies. Cookies are pieces of information stored directly on the device that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while using the Services. We also use cookies to gather statistical information about use of the Services in order to continually improve their design, functionality, and use. - By aggregating information. Aggregated information does not personally identify you (for example, we may aggregate telephone numbers to calculate the percentage of our users from a particular telephone area code).
At this time, we do not respond to browser "Do-Not-Track" signals.

We may use and disclose Other Information for any purpose. We will treat Other Information as Personal Information if required to do so by applicable law. Also, if we combine Other Information with Personal Information, we will treat the combination as Personal Information.

We are committed to providing security for personal and business information. We use reasonable methods to protect information - unfortunately, no security measure can be guaranteed 100% secure.

- Individuals who are granted password access to restricted information on Boyd Gaming websites are prohibited from sharing those passwords with anyone. Sale of Personal Information
We have not "sold" Personal Information for purposes of the CCPA, CPA, CTDPA, TDPSA, UCPA or VCDPA. For purposes of this section of our Privacy Policy, “sold” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration but does not include, for example, the transfer of Personal Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business. We do not knowingly sell the Personal Information of individuals under the age of 16.
Your rights
If you are a California, Colorado, Connecticut, Texas, Utah, or Virginia resident, you may request that we delete or correct Personal Information we collected from you and that we disclose to you the following information covering the 12 months preceding your request:
- The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
- The specific pieces of Personal Information we collected about you;
- The business or commercial purpose for collecting Personal Information about you; and
- The categories of Personal Information about you that we disclosed and the categories of third parties to
whom we disclosed such Personal Information.
To make a request, please use the Privacy Request Form, or contact us via email or 844-912-0492. We may request information from you to verify your identity, such as your email address, phone number, and Boyd Rewards program number. If you would like an authorized agent to make a request on your behalf, the agent must do so by contacting us via email or 844-912-0492. Upon receipt of a request from an agent, we will require the agent's power of attorney or signed written permission that you have authorized the agent to act on your behalf. We may also require you to verify your own identity directly with us.
We will respond to your request consistent with applicable law. Residents of certain states may have the right to appeal decisions we make with respect to requests to exercise the rights mentioned above. These residents may send us an email requesting an appeal of our decision. In your email provide your contact information, your privacy request ID from your privacy request email, and describe the reason for your appeal.
We do not discriminate when you exercise your rights under data privacy laws such as CCPA, CPA, CTDPA, TDPSA, UCPA, or VCDPA.
