Boyd Gaming Corporation (“we,” “us,” or “our”) knows that privacy matters. We use information about you to improve and personalize the services we offer you to make your experience with us as rewarding as possible. This privacy policy (the “Privacy Policy”) describes how we handle information collected online via websites operated by us, software applications made available by us, social media pages that we control, mobile applications we control, email messages that we send to you, and the information we collect and use to provide you with the best experience we can offer in connection with our gaming and hotel systems, vacation booking services, and loyalty programs such as the Boyd Rewards Loyalty Program (collectively, the “Services”).

WHAT PERSONAL INFORMATION WE COLLECT
“Personal Information” is information that is linked or reasonable linked to you as an identifiable individual. Without Personal Information, we may not be able to provide you with all requested services. We may collect the following categories of Personal Information:
Information You Provide Directly to Us:
- Identifiers, including name, contact information, social media information, government-issued identifier (social security numbers, driver’s license number, license plate number), and contact information including postal address (billing and shipping addresses); email address; telephone number; social media account ID; and Boyd Rewards account number and other loyalty program information.
- Pictures and recordings of you, including profile pictures, and audio, electronic, visual, and similar information.
- Financial information, including credit and debit card numbers and banking and financial account information and commercial information such as transaction information, account use history, and purchase history.
- Biometric data, such as fingerprints, facial recognition, and other information that permits us to identify an individual.
- Precise geolocation information, including precise location based on information from your mobile device, GPS, Wi-Fi, IP address, and other device information, with your consent where required by law and consistent with your mobile device or application permissions.
Information We Collect Automatically:
- Internet or other electronic network activity information, including device ID, internet protocol (IP) address (and your approximate location derived from your IP address), or other unique personal or online identifiers; browser type, referring / exit pages and URLs, other browser history, platform type, clicks, and other traffic data, pages viewed, the amount of time spent on particular pages; and payment events, and related date and time information.
- If you experience an error, we collect information about the error, the time the error occurred, the feature being used, the state of the application when the error occurred, and any communications or content provided at the time the error occurred. All of this information allows us to understand how the Services are used, improve the Services, and communicate with you, both for customer support and to suggest other products or services that may be of interest to you.
Information We Collect from Other Sources:
- We also receive the categories of information described above from other sources, which includes government entities that make information publicly available, entities that sell data, and third-party services and organizations. For example, if you access any social media or similar services through the Services to login or to share information about your experience with our Services with others, we may collect information from these third-party services.
Without this information, we may not be able to provide you with all requested Services.
We may aggregate or de-identify the information you provide or that we collect automatically. Aggregated or de-identified data is not subject to this Privacy Policy. Because aggregated or de-identified information does not identify any particular individual, we may freely use and disclose such information.
Our third-party analytics tools (such as Google Analytics, Adobe, DoubleClick, and others) may collect statistical information about your use of the Services to help us understand how the Services are used and how to make them better. Some of the categories of information described above may be considered “sensitive” under applicable law. In the event we collect sensitive personal information, we collect, use, or disclose it only for purposes permitted under applicable law.
HOW WE USE PERSONAL INFORMATION
We may use Personal Information that we collect for our general commercial or business purposes. Our uses of the information we collect may include:
- Answer your questions. To respond to your inquiries and fulfill your requests, for example, sending you newsletters.
- Sharing administrative information. To send administrative information to you, for example: sending information regarding the Services and changes to our terms, conditions, and policies, or information regarding your gaming activity.
- Purchases. To complete and fulfill your purchase, for example: processing your payments, confirming your reservation, communicating with you regarding a reservation or purchase, and providing you with related customer service.
- Mobile features. To help you engage with our mobile apps and our online services, for example: using the Boyd Rewards mobile app, or the VIP Player Club, to find the casinos nearest you, using our other mobile apps to participate in online gaming, connecting to gaming machines through your personal mobile device (for example, through a Bluetooth pairing), and receiving notifications from the casino you are visiting.
- Marketing. To enhance our marketing efforts and to send you marketing communications that we believe may be of interest to you.
- Personalized experiences. To personalize your experience by presenting products and offers tailored to you, as well as personalizing, advertising, and marketing our products and services.
- Contests. To allow you to participate in sweepstakes, contests, and similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use or disclose your Personal Information. We suggest you read these additional rules carefully.
- Communications. To allow you to send messages to another individual through the Services.
- Geolocation information. We may use your geolocation information to send you offers, tailored advertisements and promotions, and make available other location-specific services. We may also use geofencing technology that interacts with your device's location capabilities to determine whether you've entered a specific location. Information from geofencing technology helps us confirm that you are located in a particular jurisdiction where you are permitted to use certain Services. We may also use geofencing technology to determine when you enter a specific location where we and our third party partners may send you offers, advertisements, or provide services tailored to that location. If you chose not to share your location information with us, you may lose access to certain Services.
- Other business purposes. To support the products and services which make your experience with us as rewarding as possible and to otherwise support our business. These purposes include, for example, developing, improving, and maintaining our properties, products, and services and otherwise operating and expanding our business. In addition: conducting audits and internal investigations, research, analytics, and data analysis, accounting, maintaining our facilities and infrastructure, undertaking quality and safety assurance measures, determining the effectiveness of our promotional campaigns, performing identity verification, and maintaining records.
- Legal compliance & fraud detection. As we believe to be appropriate or necessary: (1) to comply with laws or with legal process served on us as well as with our internal policies; (2) to respond to requests from public and government authorities; (3) to enforce our terms and conditions; (4) for fraud monitoring, detection, and prevention; and (5) otherwise to protect and defend the rights, privacy, property, safety, or operations of us, you, or our affiliates (including through surveillance).
WHEN WE DISCLOSE INFORMATION
We may disclose these categories of Personal Information, including currently and in the preceding 12 months, to the following third parties and for the following business purposes:
- Our affiliates. We may disclose information you provide to us, information we collect automatically, and information we collect from other sources with our affiliates for the purposes described in this Privacy Policy.
- Business partners and service providers. We may disclose information you provide to us, information we collect automatically, and information we collect from other sources to our business partners and service providers who provide services for a variety of business purposes, such as website hosting, application development and hosting, data analysis, payment processing, order fulfillment, show and event ticketing, reservation management, credit and other bank account authorization, technology-driven services, customer service, email delivery, auditing, and other services.
- Social media account providers. We may disclose information you provide to us, information we collect automatically, and information we collect from other sources to your friends associated with your social media account, with other website users and with your social media account providers, in connection with your social sharing activity, such as if you connect your social media account to a Service account or log into your account on the Service through your social media account. By connecting your Boyd account and your social media account, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the privacy policy of the social media company.
- Other parties in connection with transactions. We may disclose information you provide to us, information we collect automatically, and information we collect from other sources in connection with any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
- Other parties when required by law or as necessary to protect our Services. There may be instances when we disclose information you provide to us, information we collect automatically, and information we collect from other sources to other parties, including to comply with the law or respond to compulsory legal process (such as a search warrant or other court order); to verify or enforce compliance with the policies governing our Services; and to protect our rights, property, or safety.
- We do not sell (as “sell” is traditionally defined) your personal information; we do not provide your personal information to third parties in exchange for money. We do permit third parties to collect information through our emails and Services and disclose such information to third parties for business purposes as described in this Privacy Policy, including but not limited to providing advertising on our Services and elsewhere based on users' online activities over time and across different sites, services, and devices (so-called “interest-based advertising” or “Targeted Advertising”). The information practices of these third parties are not covered by this Privacy Policy.
YOUR RIGHTS AND CHOICES
Depending on where you live, you may have certain rights, including:
- Right to Know. You may have the right to know additional information about how we process your personal information, such as what personal information we have collected about you or to whom we have disclosed it.
- Right to Access and Data Portability. You may have the right to request that we disclose certain information to you about our collection and use of your Personal Information, including in a portable format.
- Right to Delete. You may have the right to request that we delete your Personal Information that we collected from you and retained, subject to certain exceptions and legal obligations.
- Right to Correct. You may have the right to request that we correct any inaccurate personal information we maintain about you.
- Right to Opt-Out of Targeted Advertising. You may have the right to direct us to not share your personal information for targeted advertising. We also support the Global Privacy Control, which is a browser-based opt-out preference signal that can communicate your opt-out to the websites you visit. Note that because the Global Privacy Control is a browser-based mechanism, your opt-out preference may apply only to the browser from which you exercised that choice. You are welcome, however, to enable the Global Privacy Control on all of your browsers across your devices.
These rights are not absolute and are subject to limitations and exceptions provided in applicable law, such as when we are retaining personal information to comply with our legal obligations. You will not be discriminated against as a result of your choice to exercise these rights, although some of the functionality and features available on the Services may change or no longer be available to you if you exercise your rights.
To exercise your rights to know, access, delete, correct, or opt-out of targeted advertising, please submit a request through the Privacy Request Form: www.boydgaming.com/askprivacy. In your request, please make clear what Personal Information you would like to know about or access, or if you would like to delete or correct the personal information or opt out.
Only you, or, depending on where you reside, someone legally authorized to act on your behalf, may make a request to exercise a right related to your Personal Information. If you wish to contact us through an authorized agent, we require evidence that the agent has valid written authority to submit requests to exercise rights on your behalf. For your protection, we cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Delays in implementing your request may occur as we take reasonable steps to verify your identity.
If you live in a jurisdiction where you have the right to appeal any denials of your requests, you may file your appeal using the above mechanisms.
You can terminate your account at any time. We may, however, keep information about you following termination of your account. In some cases, we may be legally required to maintain certain records of your Personal Information, in which case we may not be permitted to delete your information. You can also directly unsubscribe from receiving marketing emails from us by: (1) clicking on unsubscribe links in marketing emails, or (2) if you are a Boyd Rewards member, visiting https://rewards.boydgaming.com to sign in and update your profile. Please note that if you opt out of receiving marketing emails from us, we may still send you administrative and other non-marketing messages.
When you install our Services on a mobile device, you can choose to receive push notifications, which are messages an application sends you on your mobile device even when the application is not active. You can turn off notifications by visiting your mobile device's “settings” page for external applications.
If you registered to receive SMS messages, you can opt out of receiving SMS messages (text messages for example) by texting back STOP to the number we send the text from for that particular SMS Message program. When we receive an opt-out message from you for SMS messages, we may send a message confirming our receipt of your opt-out.
THIRD PARTY SERVICES
This Privacy Policy does not address, and we are not responsible for, the privacy or security practices of any third parties, including any third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.
COOKIES AND TRACKING
Cookies. When you use our Services, we and our third-party advertising partners may use cookies, pixel tags, local storage, and other similar technologies (collectively “cookies”) to collect information from your browser or device. We may use cookies – including essential, preference, performance, and content/advertising cookies – to understand your visit to our Services, help us to improve our Services, and to personalize the content and advertisements that you see from us, including for purposes of targeted advertising. Third-party advertising partners may place or recognize a unique cookie on your device and across your other devices including through the use of pixel tags. You can use the settings in your browser to control how cookies are used, including blocking and deleting cookies you don't want. “Do Not Track” Signals. Some mobile and web browsers transmit “do-not-track” signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
SECURITY
We are committed to providing security for personal and business information. We use reasonable methods to protect information. Unfortunately, no security measure can be guaranteed 100% secure.
- Email and instant messaging are not recognized as secure communications, so we request that you not send sensitive information to us by email or instant messaging services.
- Individuals who are granted
password access to restricted information on Boyd Gaming websites are
prohibited from sharing those passwords with anyone. By accepting password
access to a Boyd Gaming website, you agree to protect the password from
discovery by anyone else. Boyd Gaming will not be responsible for any
damages caused by the unauthorized use of your account. You are
responsible for all activities that occur under your account. To protect
against anyone acquiring your password, the following security measures
are some, but not all, best practices:
- Create a strong password.
- Never give out your User ID or password.
- If you suspect that someone may have figured out your password, or even if you think it might have gotten lost, stolen, copied, or in any other way, compromised, please change it immediately and let us know.

DATA RETENTION
We will retain your Personal Information for at least as long as needed or permitted for the purpose(s) described in this Privacy Policy and consistent with applicable law.
INDIVIDUALS UNDER THE AGE OF 21 PROHIBITED
Our online Services are intended for use by users who are 21 years of age and older only. Persons under 21 are not permitted to use the Services, and we do not knowingly collect or solicit Personal Information from anyone under the age of 21, or knowingly allow such persons to register for use of the Services. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION
The Services are controlled and operated by us from the United States and Canada. Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers or subprocessor(s). By using the Services, you understand that we may transfer information to countries outside of your country of residence, including the United States and Canada, which may have different data protection rules than those of your country.
